These Terms and Conditions set out the basis on which House Clearance Kensington provides house clearance and associated waste collection services to customers in the United Kingdom. By booking a service, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and House Clearance Kensington.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation that requests or purchases services from House Clearance Kensington.

Services means house clearance, waste collection, removal, loading, transportation and lawful disposal or recycling of items, together with any additional services agreed in writing.

Premises means the property or location where the services are to be carried out.

Waste means any items, materials, furniture, appliances or other goods to be removed, collected or disposed of as part of the services.

2. Scope of Services

House Clearance Kensington provides house clearance and waste collection services including, but not limited to, the removal of household items, furniture, general waste, recyclable materials and certain electrical goods, subject to relevant regulations.

The specific scope of services for each booking will be as described in our written quotation or booking confirmation, including any limitations, estimated volumes, and price. We do not undertake services that require specialist licensing unless expressly stated, such as clinical waste removal, asbestos removal or hazardous chemical disposal.

We reserve the right to refuse to remove any items that we reasonably believe may be hazardous, illegal, contaminated or otherwise unsuitable for transportation or standard waste processing.

3. Booking Process

3.1 Enquiries and quotations

Customers may request a quotation by telephone, email or online enquiry. Quotations are based on the information you provide regarding the type and volume of items, access to the premises and any special requirements. All quotations are provided in good faith but do not constitute a binding agreement until a booking is confirmed.

3.2 Booking confirmation

A booking is confirmed when we have agreed the date, approximate arrival time, scope of work and price with you, and you have accepted these Terms and Conditions. Confirmation may be provided verbally, by email, text message or other written communication.

3.3 Access and information

You must ensure that accurate information is provided at the time of booking, including details of the premises, access arrangements, parking restrictions, the nature of the waste and any potential obstacles. You are responsible for securing any necessary permissions for access, parking or building entry.

If on arrival the circumstances differ significantly from those described at the time of booking, we reserve the right to adjust the price, alter the scope of the services or cancel the booking.

4. Pricing and Quotations

4.1 Price structure

Prices may be based on factors including estimated waste volume, weight, type of materials, labour time required, access conditions and any disposal charges. Unless otherwise stated, quoted prices are inclusive of standard waste transfer and disposal fees but exclusive of any additional costs arising from special items, restricted access or regulatory surcharges.

4.2 Estimates and revisions

Where a price is given as an estimate based on information provided in advance, the final price may be revised at the time of service if the actual volume or nature of waste differs materially from that described. Our team will explain any necessary pricing adjustments before proceeding.

4.3 Additional charges

Additional charges may apply for restricted or paid parking, congestion or clean air zone charges, waiting time due to lack of access, items requiring specialist handling, or extra labour beyond the originally agreed scope. Any such charges will be explained to you as soon as reasonably possible.

5. Payments

5.1 Payment terms

Unless otherwise agreed in writing, payment is due in full on completion of the services on the day of collection. For some bookings, we may require a deposit or full prepayment to secure the appointment.

5.2 Accepted payment methods

We may accept cash, bank transfer, or card payment, subject to availability at the time of service. Payment methods will be confirmed during the booking process. You are responsible for ensuring that funds are available and payment can be processed without delay.

5.3 Late or non-payment

If payment is not made in accordance with these Terms and Conditions, we reserve the right to suspend services, charge reasonable administration fees, and pursue any outstanding sums through appropriate legal or debt recovery channels. Title to any items removed does not transfer back to you once the waste has been collected for disposal.

6. Cancellations and Amendments

6.1 Customer cancellations

You may cancel or amend a booking by giving us reasonable prior notice. Where possible, we ask for at least 24 hours notice for cancellations or amendments. Cancellations made with insufficient notice may be subject to a cancellation charge, particularly where we have incurred costs or reserved resources specifically for your booking.

6.2 No access or missed appointments

If our team attends the premises at the agreed time and is unable to gain access, or the services cannot be carried out due to circumstances within your control, we may charge a call-out or cancellation fee to cover our costs.

6.3 Cancellations by House Clearance Kensington

We reserve the right to cancel or reschedule a booking in the event of unforeseen circumstances, such as staff illness, vehicle breakdown, extreme weather, safety concerns or regulatory issues. We will notify you as soon as reasonably practicable and, where possible, offer an alternative appointment. We will not be liable for any indirect losses arising from such cancellations.

7. Customer Obligations

7.1 Access and preparation

You must ensure that our team has safe and reasonable access to the premises, including necessary keys, codes or permissions. The areas to be cleared should be reasonably accessible, with any fragile or valuable items either removed or clearly identified as not to be taken.

7.2 Ownership and authority

By booking our services, you confirm that you are the owner of the items to be removed or that you have full authority from the owner to arrange their removal and disposal. You agree to indemnify House Clearance Kensington against any claims from third parties relating to ownership of items cleared at your instruction.

7.3 Hazardous and prohibited items

You must inform us in advance of any hazardous, restricted or specialist items present at the premises. We reserve the right not to handle such items and may charge for any additional time spent assessing or making safe the environment.

8. Performance of Services

8.1 Time of arrival

We will aim to attend the premises within the agreed time window. However, arrival times are estimates and may be affected by traffic, weather, operational delays or other factors beyond our control. We will endeavour to keep you informed of any significant delays.

8.2 Conduct and care

Our team will carry out the services with reasonable care and skill, taking into account the nature of house clearance and the condition of the premises. While we will take reasonable steps to avoid damage, some minor scuffs or marks can occur when moving bulky items through tight spaces. You should take reasonable precautions, such as protecting delicate surfaces, where appropriate.

8.3 Completion

The services will be considered complete when the agreed items have been removed from the premises and loaded for transportation. You may be asked to confirm completion and satisfaction before our team departs.

9. Waste Handling and Regulations

9.1 Legal compliance

House Clearance Kensington will handle, transport and dispose of waste in accordance with applicable UK waste management laws and regulations. We will only use authorised waste transfer and disposal facilities.

9.2 Waste transfer and recycling

Once collected, items become the responsibility of House Clearance Kensington for the purposes of sorting, recycling, reuse or disposal. We may separate materials for recycling where practicable and in line with local regulations and facility capabilities.

9.3 Prohibited or restricted waste

Certain types of waste may be restricted or require specialist treatment, such as hazardous chemicals, asbestos, gas cylinders, medical waste, flammable substances or pressurised containers. We do not generally collect these materials. If such items are discovered during the service, we may refuse to handle them and may charge for any time lost or additional safety measures required.

10. Liability and Insurance

10.1 Our liability to you

House Clearance Kensington will use reasonable care and skill in providing the services. Our liability to you for any direct loss or damage arising from our negligence or breach of contract is limited to the total price paid or payable for the specific services giving rise to the claim.

10.2 Exclusions

We will not be liable for any loss or damage that is indirect, consequential, or not reasonably foreseeable, including loss of profits, loss of opportunity, emotional distress or purely economic loss. We are not liable for pre-existing damage, structural defects, hidden weaknesses or any deterioration associated with normal wear and tear.

10.3 Customer responsibilities

You are responsible for checking that no items you wish to keep are removed during the clearance. We cannot accept liability for items taken away in error if they were not clearly identified as to be retained. You should ensure that valuables, important documents and personal effects are removed from the clearance area prior to our arrival.

10.4 Insurance

House Clearance Kensington maintains appropriate public liability insurance in connection with the services provided. Details of our insurance cover are available upon request.

11. Complaints and Disputes

11.1 Raising a complaint

If you are dissatisfied with any aspect of our services, you should notify us as soon as possible, ideally within 48 hours of completion. We may request supporting information or evidence in order to investigate your complaint properly.

11.2 Resolution

We will use reasonable efforts to resolve complaints promptly and fairly, which may include rectifying issues, offering a partial refund or taking other appropriate steps where we are found to be at fault. Our decision will take into account the nature of the services, the condition of the premises, and the reasonableness of the actions taken by both parties.

12. Data Protection and Privacy

We will handle any personal information you provide in accordance with applicable data protection laws. Personal data may be used to process bookings, provide services, manage payments, handle complaints and meet legal obligations. We will take reasonable measures to keep your information secure and will not share it with third parties other than as necessary for service delivery, legal compliance or debt recovery.

13. Force Majeure

House Clearance Kensington will not be liable for any delay or failure to perform our obligations under these Terms and Conditions where such delay or failure is due to events beyond our reasonable control, including but not limited to extreme weather, natural disasters, accidents, strikes, acts of terrorism, war, civil unrest, pandemics, utility failures or regulatory changes.

14. Amendments to Terms

We may update these Terms and Conditions from time to time. The version in force at the time of your booking will apply to the services provided under that booking. You are encouraged to review the Terms and Conditions periodically to stay informed of any changes.

15. Governing Law and Jurisdiction

These Terms and Conditions, and any non-contractual obligations arising out of or in connection with them, are governed by and interpreted in accordance with the laws of England and Wales.

Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales, although we retain the right to bring proceedings against you in any other court of competent jurisdiction.

16. General Provisions

16.1 Entire agreement

These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and House Clearance Kensington in relation to the services and supersede any prior understandings or agreements.

16.2 Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision will be deemed deleted, and the remaining provisions will continue in full force and effect.

16.3 No waiver

Any failure or delay by House Clearance Kensington in exercising any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy, nor does it prevent or restrict any further exercise of that or any other right or remedy.
